Nature and purpose of OLDPIK

OLDPIK.COM is a cultural, documentary, educational and informative project dedicated to the conservation, cataloguing, contextualisation, research and dissemination of historical photographic heritage.

Its purpose is to contribute to the knowledge of history and of social, cultural, urban, territorial and human evolution through historical photography.

To this end, OLDPIK endeavours to include, whenever the available information allows it, data regarding the date, location, people, events, historical context, authorship and provenance of the photographs.

OLDPIK also operates as a collaborative archive, allowing its users to contribute photographs and historical information that help preserve the collective photographic memory.

OLDPIK currently carries out this activity on a non-profit basis. Access to the archive is free of charge and OLDPIK does not sell or grant licences over the historical photographs added to the project by third parties.

This cultural, educational and non-profit purpose does not mean that OLDPIK considers any content available on the Internet to be freely usable, nor does it exclude the intellectual property rights, image rights or other legitimate rights that may belong to third parties.

3

General conditions of use

Accessing and using OLDPIK implies acceptance of these conditions.

Users must use the platform lawfully and with respect for the rights of third parties.

In particular, they must not use OLDPIK to deliberately add content whose publication infringes intellectual or industrial property rights, the rights to honour, privacy or one's own image, personal data protection or any other applicable regulation.

OLDPIK may remove, hide, correct or restrict access to any content when there are well-founded reasons to consider that it could infringe the law, these terms or the legitimate rights of third parties.

4

Intellectual property of OLDPIK

OLDPIK's own elements —including its design, programming, structure, logos, graphic elements, its own texts, databases and other content created specifically by OLDPIK— belong to Alpex Digital, S.L. or are used with the authorisation of their respective owners, unless otherwise indicated.

This ownership does not automatically extend to the historical photographs included in the archive, whose rights belong, where they subsist, to their respective authors, successors in title or rights holders.

The inclusion of a photograph in OLDPIK does not imply that Alpex Digital, S.L. claims its authorship or ownership.

5

Historical photographs and public domain

OLDPIK contains historical photographs subject to different legal situations.

These may include:

a

photographs and works whose exploitation rights have expired and which are in the public domain;

b

photographs whose reuse has been authorised by means of a licence;

c

photographs contributed by their authors, rights holders or duly authorised persons;

d

photographs used in those cases and within those limits permitted by the legislation in force;

e

photographs whose authorship, provenance or legal status could not be fully determined after carrying out reasonable checks.

The age of a photograph is a relevant factor, but OLDPIK does not presume that a photograph is in the public domain solely because of the date on which it was taken.

Where exploitation rights have expired, works in the public domain may be used in accordance with the legislation in force, respecting, where applicable, the authorship and integrity of the work.

6

Sources and provenance of the photographs

OLDPIK endeavours to identify and preserve the known source or provenance of the photographs and, where possible and useful, to provide a link to that source.

The indication of a source is intended to support traceability, attribution, research and historical documentation.

The existence of a photograph on a website, social network, digital archive or other publicly accessible source does not in itself mean that the photograph is free of rights or that its reproduction is automatically authorised.

Likewise, the inclusion by OLDPIK of a link to an external source does not mean that OLDPIK necessarily attributes to that source the authorship or ownership of the rights over the photograph.

When more precise information about the authorship, provenance or legal status of a photograph is subsequently obtained, OLDPIK may correct or complete its record.

7

Educational, documentary and research purpose

Historical photographs can be relevant documents for understanding events, places, customs, urban transformations, people and ways of life of the past.

OLDPIK endeavours to place photographs within a documentary context by means of historical, geographical, chronological or descriptive information.

When a protected photograph is used under any of the limits provided for in intellectual property legislation, it will be used only within the conditions and to the extent permitted by the applicable regulations.

The educational, cultural, documentary or research purpose of OLDPIK does not in itself constitute a general authorisation to reproduce protected works.

8

Attribution and correction of information

OLDPIK endeavours to identify the photographer or author when that information is known or reasonably verifiable.

Historical attributions may contain errors, discrepancies between archives or incomplete information.

Any author, researcher, archive, institution, family member or user who has documented information that makes it possible to correct a date, authorship, location, identification or description may send it to:

hello@oldpik.com

OLDPIK may review and correct the information when there is sufficient evidence to do so.

9

Claims regarding rights over photographs

OLDPIK respects intellectual property rights and maintains a procedure for the notification and review of content.

Anyone who considers that a photograph published on OLDPIK infringes rights that legitimately belong to them may write to:

hello@oldpik.com

To enable a quick check, it is recommended to indicate:

the specific URL of the photograph on OLDPIK;

identification of the photograph;

name of the author, if known;

the right whose ownership is claimed;

relationship of the claimant to the author or rights holder;

documentation or information that reasonably proves the validity and ownership of the right;

the action requested.

Once a sufficiently identified claim has been received, OLDPIK may remove or hide the content as a precaution while it examines the available information.

The precautionary removal of a photograph does not imply acknowledgement of infringement, liability or ownership; it is a measure intended to avoid disputes while its status is verified.

When the claim is well founded, OLDPIK will maintain the removal or make the necessary changes.

When there are reasonable doubts about the authorship, validity or ownership of the rights, OLDPIK may request additional information before making a final decision.

10

Content contributed by users

Photographs and other content contributed by users remain subject to the rights belonging to their respective holders.

Anyone contributing content must comply with the OLDPIK Terms and Conditions and make sure that they are sufficiently entitled to publish it or that such use is legally permitted.

OLDPIK may delete content contributed by users when it breaches these conditions.

11

External links

OLDPIK contains links to websites, archives, libraries, museums, social networks and other external sources, mainly for documentary and reference purposes.

OLDPIK does not necessarily control those sites and is not responsible for their content, availability or policies.

The existence of a link does not imply approval, a commercial relationship or recognition of ownership over the photographs that may be found on the linked page.

12

Image rights, honour and privacy

The fact that a photograph is old or in the public domain from an intellectual property standpoint does not automatically exclude the possible application of other rights.

OLDPIK will take particular care to avoid uses that may unlawfully infringe the rights to honour, privacy, one's own image or other rights protected by law.

Persons who consider that these rights are legitimately affected may use the contact procedure indicated above.

13

Disclaimer of liability

OLDPIK makes reasonable efforts to improve the historical and legal accuracy of its content, but cannot guarantee that all information contributed by third parties is complete or free of errors.

OLDPIK is not liable for content unlawfully contributed by third parties where such knowledge or liability does not legally correspond to it, without prejudice to taking the appropriate measures when it has actual knowledge of a possible infringement.

14

Data protection and cookies

The processing of personal data carried out through OLDPIK is governed by the corresponding Privacy Policy.

The use of cookies and similar technologies is governed by the Cookie Policy and by the preferences expressed by each user.

15

Changes to the Legal Notice

OLDPIK may modify this Legal Notice to adapt it to legislative, case-law or technological changes, or to changes in the way the project operates.

The applicable version will be the one published on the website at any given time, with an indication of the date on which it was last updated.

16

Applicable law

This Legal Notice is governed by Spanish law.

Disputes will be submitted to the courts and tribunals that have jurisdiction under the applicable regulations, and these conditions may not limit the mandatory jurisdiction to which consumers or users are entitled.
